Number 12 aftermath: Kennedy Agyapong dedicates defamation case victory to Kwesi Nyantakyi

The former President of the Ghana Football Association, Kwesi Nyantakyi, has been given reason to smile after Member of Parliament for Assin Central, Kennedy Agyapong, emerged victorious in a defamation case against Anas Aremeyaw Anas.

Nyantakyi's tenure as GFA boss came to an end after he was implicated in the "Number 12" documentary by Anas in 2018. The documentary uncovered the rot in Ghana football and led to Nyantakyi being banned from football activities.

Anas had sued Agyapong for GHS 25 million in 2018, accusing him of defaming him after the politician aired his ‘who watches the watchman’ documentary video. In his writ, Anas prayed to the court to award GHC25 million against Mr Agyapong to compensate him for the defamatory material published against him by the MP.

However, in a ruling made on Wednesday, March 15, the Accra High Court dismissed the defamation suit against Agyapong. The presiding judge, Justice Eric Baah, said Anas Aremeyaw Anas failed to substantiate his claims that he had been defamed, and that the documentary aired by Mr Agyapong rather exposed the shady deals that the investigative journalist and his associates were involved in.

The court came to a conclusion that what Anas Aremeyaw Anas is engaged in is not investigative journalism but rather investigative terrorism and that Agyapong was justified to call Anas “a blackmailer, corrupt, an extortionist, and evil”. Justice Eric Baah said, “I find the claims by the plaintiff [Anas Aremeyaw Anas) meritless and they are hereby dismissed.”

Speaking to journalists after the court hearing, Mr Kennedy Agyapong said he dedicates his victory to Nyantakyi, saying “We have to be bold to speak the truth, Anas goes ahead to [allegedly] defame people and gets away.

"It is only in this country that a journalist covers his face to go and give witness while Supreme Court judges are sitting there”, Mr Agyapong said. “Anas has to come out and apologise. All I am saying is the victory is for Kwesi Nyantakyi.”
