An Accra High Court has dismissed a GHC25 million defamatory suit brought against the Member of Parliament for Assin Central in the Central Region, Kennedy Agyapong, by investigative journalist Anas Aremeyaw Anas.

The case was in relation to the documentary “Who watches the watchman” which was aired by Agyapong. Anas had sought aggravated damages of GHC25 million in his application.

"Who watches the watchman" was done in response to the Number 12 documentary by Anas that implicated football officials over alleged corruption.

Justice Eric Baah delivered a lengthy ruling today, Wednesday, March 15, 2023, stating that Anas failed to prove that Agyapong had defamed him. In fact, the documentary uncovered shady deals that Anas and his associates were involved in.

Agyapong provided evidence proving that Anas had used his work’s findings to extort money from implicated individuals. Those who paid up were reportedly exempted from videos shown to the public.

The court ruled that Agyapong’s claims of Anas being “a blackmailer, corrupt, an extortionist, and evil” were justified.

“I find the claims by the plaintiff meritless and they are hereby dismissed,” Justice Baah said.

According to Anas, Agyapong categorically stated that he was “a blackmailer, corrupt, an extortionist, and evil” during a live program on Adom TV in Twi on 29 May 2018.

Agyapong also allegedly published defamatory words about Anas on 31 May 2018 on Oman FM, which is owned by Agyapong. Pictures purportedly of the investigative journalist were also released.

Anas had stated that his reputation as a lawyer and globally acclaimed investigative journalist had been damaged as a result of the publication. Justice Baah awarded cost of GHc50,000.00 against Anas, following a request by Agyapong’s lawyers, despite Anas’ lawyers offering to pay GHc20,000.00.
